3.  How We May Use Information.

We use the information that we collect and that you provide to us for a variety of business purposes, including, but not limited to, providing you with products and services that you request from us, carrying out our obligations and enforcing our rights under our agreements with you, data analytics, marketing purposes, improving our products and services, and notifying you about additional products or services that may be of interest to you. We do not sell or rent your information.

(a) To Provide Services to You and Others

(i) To allow you to monitor the status of Assets, to complete and fulfill orders, and to communicate with you regarding your purchase or rental of Assets and your purchase of Asset parts and provide you with related customer service.

(ii) To fulfill Client support agreements, perform maintenance and repairs and deliver rental Assets or parts.

(iii) To make recommendations regarding safety, Asset health, maintenance, worksite efficiency and productivity training for operators.

(iv) To enhance the safety of machine operations, including by tracking proximity to Assets, other objects or humans.

(v) To enable remote technician services, such as remote troubleshooting, and remote tuning.

(vi) To provide you with location-based services and content.

(vii) To process payment related to our products and services.

(b) To Enable Communications:

(i) To send administrative or contractual information, for example, information regarding our terms and conditions of sale and rent and of using Digital Offerings, warranty policies or service contracts and in respect of debt recovery.

(ii) To provide you with information about new products and services and to send you marketing communications that we believe may be of interest to you for which you may opt-out at any time.

(c) For Other General Business Purposes:

(i) To conduct market research.

(ii) To perform data analytics, audits, improve products, develop new products, enhance, improve or modify our Digital Offerings, identify usage trends and operate and expand our business activities and for statistical analysis based on aggregated and de-identified data, such as benchmarking reports.

(iii) To provide services to Clients, manage work flow, monitor repairs, project future maintenance and service, and troubleshoot issues.

(iv) To validate effectiveness of recommendations, resolve complaints, and fulfill orders.

(v) To manage Assets and parts inventory in order to provide you with machines, parts and services.

(vi) To manage a fleet of owned or rented Assets.

(vii) To maximize the efficiency of operations and increase sales.

(viii) To develop digital Applications.

(ix) To manage your account with us and generally keep our records up to date and to administer our relationship with you.

(d) Other Uses:

(i)  To allow you to participate in sweepstakes, competitions or similar promotions and to administer these activities. Some of these activities have additional rules, which could contain additional information about how we use and disclose your information, including Personal Information. We suggest that you read any such rules carefully.

(ii) For additional uses as agreed by you and us, which may, for example, arise from new types of products or services that we may offer you.

4. How We Store and Protect Information

We have implemented reasonable measures to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure. However, the transmission of information is not completely secure. We cannot guarantee the security of Personal Information transmitted to us at or through our Contact Centers, and any transmission of such information is at your own risk. Our website may contain links to third-party websites and online services. We are not responsible for the privacy practices or content of third-party websites. We retain Personal Information collected from you as long as your account is active or otherwise as long as we need to fulfill the purposes for which it was collected, unless otherwise required by law.

5. Information We May Share with Third Parties

We may disclose Personal Information that we collect or that you provide to our parent, subsidiary and affiliated entities, to our manufacturers and their subsidiaries and affiliates, and to contractors, service providers and other third parties used to support our business and the business of our manufacturers (collectively, the “C2C Power Solutions and Manufacturer Entities”). We also may disclose such information if required by law, to enforce our rights or if we have a good faith belief that such disclosure is necessary or appropriate to protect the rights, property, or safety of C2C Power Solutions, our clients or others. Additionally, any Personal Information that you provide may be transferred in a merger, acquisition, restructuring, or other corporate transaction involving C2C Power Solutions or its Assets.  

6. Children

We do not want to collect or maintain information from those under the age of 16. No part of our website is structured to attract anyone under the age of 16. By using our website, you represent that you are not less than 16 years of age.

7. Access, Changes, and Corrections

Subject to certain exceptions prescribed by law, you have a right to access or request correction or deletion of most personal data that we have about you. In some circumstances, it may not be possible for us to provide you with all of your personal data. For instance, there may be instances where disclosing the requested information would impact the privacy of another individual. Where we cannot provide access to personal data held about you, we will tell you why.

If you think that any personal data we hold about you is inaccurate, you may contact us using the contact details below and we will take reasonable steps to ensure that the information is corrected. We may take steps to verify your identity before providing you access to your personal data.

If you send any request for access to or correction of your personal data, we will do our best to respond within a reasonable period after your request. We may retain all information you submit for backups, archiving, prevention of fraud, legal compliance or where we have a legitimate reason to do so.

8. International Transfer

If you are accessing the website from outside the United States, you are sending information, including Personal Information to the United States where our servers are located. That information may then be transferred within the United States or back out of the United States to other countries outside your country of residence. These countries may not necessarily have data protection laws as comprehensive as those in your country. Information transferred to the United States or another country is subject to the laws of that country and may be disclosed or accessed in accordance with those laws. By transferring information or allowing information to be transferred to us, you consent to the transfer, processing and storage in countries outside your country of residence.

9. Do Not Track’ Notifications

Some browsers allow you to automatically notify websites you visit not to track you using a “Do Not Track” signal. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, we currently do not alter our practices when we receive a “Do Not Track” signal from a visitor’s browser.

11. Caterpillar Data Governance

Caterpillar’s Data Governance Statement, together with Caterpillar’s Global Privacy Statement and any applicable Caterpillar Privacy Notices for its digital offering subscriptions, describes Caterpillar’s practices for collecting, sharing and using data and information relating to machines, products or other assets and their associated worksites–for example to enable Cat® Connect and other Digital Offerings.  The Data Governance Statement also describes how Caterpillar may perform remote diagnostics and make available remote software and firmware updates and upgrades, such as configuration, patches, bug fixes, new or enhanced features, etc., for your Assets and Devices.  By providing data and information to Dealer as described herein or to Caterpillar as described in Caterpillar’s Data Governance Statement, you agree to its terms as it may be revised from time to time.
